Mediation is a guided, informal negotiation process, where parties in conflict come together in good faith, discuss their different points of view, and work together with a neutral, third party -- the mediator -- towards a mutually agreeable resolution outside of court.

WHAT IS MEDIATION?

Our Approach

Innovative ADR’s Doug Witten has years of mediation experience, having worked with thousands of disputing parties to craft agreeable resolutions. Doug’s thoughtful approach to conflict resolution is marked by flexibility, determination, attention to detail, and a deep understanding of what parties need to find closure.

Doug mediates a variety of civil matters, with a focus on injuries and workers’ compensation, medical, healthcare and insurance matters, business and commercial disputes, and cases involving Spanish-speaking parties.

Arbitration Services

Arbitration is a structured dispute resolution process by which an independent third party -- the arbitrator, or panel of arbitrators -- reviews evidence, hears arguments presented by the disputants, and then renders a decision. Disputing parties typically agree by contract to refer their disputes to arbitration as an alternative to what can be more costly, time-consuming, and formal court proceedings.

Our Approach

Innovative ADR offer arbitration services through the administering panels on which Doug Witten serves, which organizations manage the arbitration process, including American Health Law Association (AHLA), Financial Industry Regulatory Authority (FINRA), and BAY Mediation & Arbitration Services.

Online Dispute Resolution

Online Dispute Resolution (ODR) allows parties in dispute to use technology to help resolve disputes. Through videoconferencing and other means of digital connectivity and platforms, ODR enables parties to communicate, even when separated by time, physical distance, or both, and work towards resolution with increasingly common ease.

Innovative ADR’s Doug Witten has been specially trained to conduct ODR proceedings and has both mediated and arbitrated using online, digital, and telephonic communications, all tailored to the needs of the particular case and parties.

Training & Coaching

Innovative ADR’s Doug Witten has amassed thousands of hours of experience, working with thousands of disputants, to hone his negotiation skills. Having experienced firsthand what works well -- and what not so well -- and observing the traits and tactics of expert negotiators, Doug understands what it takes to reach resolution.

Our Approach
